Terms of Service

These Terms of Service ("Terms") govern your use of the AppForgeLabs website (https://appforgelabs.com) and of the software products, websites, APIs, and services operated by AppForgeLabs LLC, a New Mexico limited liability company ("we", "us", "our"). By using any of them, you agree to these Terms.

1. Products with their own terms

Some products publish their own terms of service. Those product terms govern that product. These general Terms apply to anything the product terms do not cover, and if the two conflict, the product terms prevail for that product.

2. Accounts and credentials

Where a product offers an account, API key, or similar credential, you are responsible for keeping it secure and for all activity under it. Tell us at [email protected] if you believe it has been compromised. We may suspend credentials that appear leaked, abused, or unpaid.

3. Purchases and subscriptions

Prices are shown before you pay, in US dollars unless stated otherwise. Payments are processed by Stripe; we do not store full card numbers. Subscriptions renew at the end of each billing period until you cancel, which you can do through the billing portal linked from the product or by emailing us before the renewal date. Fees already paid are not refundable except where the product terms say otherwise or the law requires it. We may change prices for future billing periods with notice.

4. Acceptable use

You agree not to:

  • break the law, or use our products to send spam or harmful content;
  • overload or disrupt our services, or evade rate limits or access controls;
  • access another customer's account, keys, or data;
  • resell or redistribute a product or its output in a way its product terms do not allow.

We may suspend or end access for abuse, non-payment, or legal risk.

5. Intellectual property

Our websites, software, and documentation are owned by AppForgeLabs LLC or its licensors. Using a product gives you a limited, non-exclusive, non-transferable license to use it as described by that product. Content you provide stays yours; you grant us the rights needed to operate the product for you.

6. Third-party services

Our products rely on third parties such as payment processors, email delivery, hosting, and messaging platforms. Their own terms apply to their services, and we are not responsible for them. Links to other websites are provided for convenience.

7. No warranty

Our websites and products are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that a product will be uninterrupted, error-free, complete, or current.

8. Limitation of liability

To the maximum extent permitted by law, AppForgeLabs LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business. Our total liability for all claims in any twelve-month period is limited to the greater of the amount you paid us for the product in that period or fifty US dollars (US $50). Some jurisdictions do not allow these limits, in which case they apply to the fullest extent permitted.

9. Changes

We may update these Terms. The effective date above changes when we do. Continued use after an update means you accept the updated Terms. We may change or discontinue products; if we discontinue a paid product you have already paid for, we will offer a pro-rata refund for the unused period.

10. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law rules. Courts located in New Mexico have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.
